On October 6, Justice Conway in Canada heard and denied yet another of TD Bank’s procedural motions to stay the action. Justice Conway determined that TD’s motion lacked merit and did not warrant the stay requested. She dismissed the motion and ordered costs for the time spent on this motion be paid by TD to the Joint Liquidators.

The case is now in the discovery phase. The court has ordered TD to produce documents to the Joint Liquidators by April 6, 2017.
